The Indian Trademark Office has had a slow week. The total number of applications published in the Trademark Journal has decreased by fifteen percent (15%). Similarly, the total number of hearing notices issued has decreased by fifty-four percent (54%). However, the total registrations granted has increased by fourteen percent (14%).

World’s leading manufacturer of darts, Unicorn Products, attempted to trademark “the smell of strong bitter beer” on their new range of darts in 1994. The olfactory trademark was successfully granted registration by the UK Trademark Registry under class 28.

INDIAN TRADEMARK UPDATES

MakeMyTrip Sues for Infringement

The online travel company, MakeMyTrip recently had filed a trademark infringement suit before the Delhi High Court against five companies – MakeMyYatra, MakeMyJourney, Make My Happy Journey, Pick My Trip and Superb My Trip for using deceptively sounding similar names and for copying its logo. The Delhi High Court passed an interim order restraining the five companies from using the marks and from directly or indirectly dealing in any products or services under the infringing marks.

‘Fight for the Fallen’ Trademark

All Elite Wrestling (AEW), the newly formed LLC based out of Florida has filed for a new tantalizing trademark for the term ‘Fight for the Fallen’ for wrestling, music and various merchandizing purposes. They have also filed for other trademarks such as ‘AEW: Double or Nothing’, ‘AEW: All Out’, ‘Tuesday Night Dynamite’ and ‘All Elite Wrestling’. These trademarks suggests that AEW’s possible direction of the new pro wrestling promotion.

GOT Merchandize by Masaba

Masaba Gupta, the leading fashion designer in Bollywood bags the official license to design Game of Thrones (GOT) merchandize that includes apparels, home décor, jewellery inspired by the cast of the show. The collection will be released during the final season of the show scheduled for around the first half of 2019. The designer known for her quirky prints and her outfits can be often spotted on popular Bollywood celebrities such as Alia Bhatt, Sonam Kapoor, Shilpa Shetty among others.

Taiwan Beverage in India

Food & Beverage franchise management company, Yellow Tie Hospitality is all set to launch the Taiwan based beverage brand Chachago in India in January 2019. Chachago, known as the ‘House of Milk Tea’ is famous for its milk teas, bubble teas, cheese-based beverages, milkshakes and desserts. The franchising company intends to open 100 outlets by 2021.

Assam’s Rice Wine to be applied for GI

Judima is the traditional rice wine consumed by the Assam’s Dimasa tribe. The rice wine is closely associated with the cultural and social life of the tribe. The Youth Association for Development and Empowerment (YADEM) has submitted its proposal to the Intellectual Property Right Act Cell (IPRC) of Assam Agriculture University (AAU) to take forward the initiative.
