    Application Filing

    Day 1
    Applicant

    Trademark application filed with the Trade Marks Registry specifying mark, goods/services classes, and applicant details. Filing date serves as priority date. Or from the date of first use of mark.

    Examination

    12-18 months
    Registry

    Registrar examines application for compliance with Trade Marks Act. May raise objections under Section 9 (absolute grounds) or Section 11 (relative grounds).

    If objections raised

    If objections raised, applicant files response. If unresolved, a Show Cause Hearing may be scheduled.

    Publication

    After acceptance
    Registry

    Accepted application to be published in Trade Marks Journal for public notice. Third parties can file opposition within 4 months.

    Opposition Period

    Window for third party to oppose the Application. If no opposition filed, the application proceeds to registration.

    If third party opposes

    Receipt of Opposition Notice → Counter Statement → Evidence Affidavit Submissions → Hearing(s) → Order. The whole opposition process may take 2-4 years.

    Registry

    Trademark registered and certificate issued. Valid for 10 years from filing date, renewable indefinitely in 10-year periods.

Madrid Protocol (130+ Countries)

Important Notes

Nice Classification: India follows the Nice Classification with 45 classes (1-34 for goods, 35-45 for services). Multi-class applications are permitted.

Madrid Protocol: India acceded in 2013. Indian applicants can file international applications designating 130+ member countries.

Renewal & Validity: Registration is valid for 10 years from filing date and can be renewed indefinitely for further 10 year periods.

Non-Use Cancellation: Trademarks may be removed if not used for 5 years and 3 months. Any interested person can file a cancellation application or rectification petition.
