Renewal Requirements

Validity Period

Trademark registrations are valid for 10 years from the filing date. Renewal extends validity for successive 10-year periods indefinitely.

Renewal Window

Renewal applications can be filed up to 6 months before expiry. This advance filing is recommended to avoid surcharges and administrative complications.

Late Renewal

Renewals can be filed within 6 months after expiry with payment of a surcharge. After this period, the mark is removed from the Register.

Restoration

A removed mark may be restored within 6 months of removal (12 months total from expiry) through a restoration application with additional fees.

Non-Use Risk

Registered marks not used for 5 years and 3 months are vulnerable to cancellation through rectification proceedings. Renewal does not protect against non-use challenges.
