A design protects the ornamental or aesthetic aspects of an article - its appearance, shape, configuration, pattern, or ornamentation. A patent protects functional aspects - how something works or is made. The same product may have both Design protection (for its appearance) and Patent protection (for its functional features). In India, designs are registered under the Designs Act, 2000, while patents are governed by the Patents Act, 1970.
To be registrable, a design must be:(1) new and original - not previously published or used in India or elsewhere;(2) applied to an article - not a method or principle;(3) not against public order or morality;(4) distinguishable from known designs; and(5) have features that appeal solely to the eye. The design must not be functional - purely functional features are not protectable as designs.
Uncontested applications typically take 3-9 months from filing to registration. Formal examination usually completes within 1-2 weeks. Substantive examination takes 2-4 months. If objections are raised, additional time is needed for responses and any hearings. Convention applications claiming priority must be filed within 6 months of the first filing.
The Locarno Classification is an international system for classifying industrial Designs into 32 classes based on the type of product. India follows this classification. Proper class selection is important as it affects the scope of protection and official fees. Multi-class applications are permitted, allowing multiple designs for different product types in a single application.
Required documents include:(1) Application form (Form 1);(2) Four sets of representations showing the design from different views (front, back, sides, top, bottom, perspective);(3) Statement of novelty identifying new features;(4) Power of attorney;(5) Priority documents if claiming convention priority;(6) Assignment deed if applicant differs from creator. E-filing requires a digital signature certificate.
Yes, graphical user interfaces (GUIs), icons, and screen displays can be registered as designs in India under Class 32 (Graphic Symbols and Logos). The visual representations must clearly show the GUI elements being claimed. Multiple screen designs can be included if they form a set or are related. The GUI must be associated with an article (display screen, device interface).
Convention priority allows applicants who first file a Design application in a Paris Convention member country to file in India within 6 months while claiming the earlier filing date as the priority date. This is shorter than the 12-month priority period for patents. Priority must be claimed at the time of filing and supported by certified copies of the priority documents.
A Design registration in India is initially valid for 10 years from the date of registration. It can be renewed for one additional period of 5 years, giving a maximum protection term of 15 years. Renewal application must be filed before expiry of the initial 10-year term, along with the prescribed renewal fee.

The applicant must respond addressing each objection within the prescribed time. Yes, India allows multi-Design applications where related designs belonging to the same class can be filed together. This is cost-effective for design families or variations. However, each design in a multi-Design application must be distinct and independently registrable. Multi-class applications are also possible but require separate fees for each class.
