President of India on the 4<sup>th<\/sup> of April 2021 promulgated the \u201c<a href=\"https:\/\/copyright.gov.in\/Documents\/Pdf\/Tribunals_Reforms__Rationalisation_And_Conditions_Of_Service__Ordinance__2021.pdf\" target=\"_blank\" rel=\"noopener\">THE TRIBUNALS REFORMS (RATIONALISATION AND CONDITIONS OF SERVICE) ORDINANCE, 2021<\/a>\u201d.\u00a0 With the passing of this ordinance, Tribunals set up under the Cinematograph Act, 1952, the Customs Act, 1962, the Airports Authority of India Act, 1994, the Trade Marks Act, 1999 and the Protection of Plant Varieties and Farmers\u2019 Rights Act, 2001 and certain other Acts have now effectively been rendered defunct with immediate effect. <\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'book antiqua', palatino, serif;\">Provided below is a table summarizing the changes introduced to the <strong>Trade Marks Act, 1999<\/strong> by virtue of passing of this Ordinance.<\/span><\/p>\n<table width=\"100%\">\n<tbody>\n<tr>\n<td width=\"11%\"><span style=\"font-family: \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">Section 47(2) (b) &#8211; on application by that person in the prescribed manner to the <strong><u>Appellate Board<\/u><\/strong> or to the Registrar, the tribunal may impose on the registration of the first-mentioned trade mark such limitations as it thinks proper for securing that registration shall cease to extend to such use.<\/span><\/td>\n<td width=\"30%\"><span style=\"font-family: 'book antiqua', palatino, serif;\">Section 47 (1) &#8211; A registered trademark may be taken off the register in respect of the goods or services in respect of which it is registered on application made in the prescribed manner to the Registrar or the <strong><u>High Court <\/u><\/strong>by any person aggrieved on the ground either.<\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">Section 47(2) (b) &#8211; on application by that person in the prescribed manner to the <strong><u>High Court or defect in any entry in the register, may apply in the prescribed manner to the <strong><u>Appellate Board<\/u><\/strong> or to the Registrar, and the tribunal may make such order for making, expunging or varying the entry as it may think fit<\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">Section 57(5)<\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">Any order of the <strong><u>Appellate Board<\/u><\/strong> rectifying the register shall direct that notice of the rectification shall be served upon the Registrar in the
