{"id":70701,"date":"2021-04-06T12:14:59","date_gmt":"2021-04-06T06:44:59","guid":{"rendered":"http:\/\/localhost\/one\/?p=70701"},"modified":"2025-07-01T15:36:52","modified_gmt":"2025-07-01T10:06:52","slug":"tribunals-reforms-ordinance-2021-patents-act-amendments-india","status":"publish","type":"post","link":"https:\/\/www.bananaip.com\/intellepedia\/tribunals-reforms-ordinance-2021-patents-act-amendments-india\/","title":{"rendered":"Tribunals Reforms Ordinance 2021 and amendments to the Patents Act, 1970"},"content":{"rendered":"<p style=\"text-align: justify;\"><span style=\"font-family: 'book antiqua', palatino, serif;\">The President of India on the 4<sup>th<\/sup> of April 2021 promulgated the \u201c<a href=\"https:\/\/copyright.gov.in\/Documents\/Pdf\/Tribunals_Reforms__Rationalisation_And_Conditions_Of_Service__Ordinance__2021.pdf\" target=\"_blank\" rel=\"noopener\">THE TRIBUNALS REFORMS (RATIONALISATION AND CONDITIONS OF SERVICE) ORDINANCE, 2021<\/a>\u201d.\u00a0 With the passing of this ordinance, Tribunals set up under the Cinematograph Act, 1952, the Customs Act, 1962, the Airports Authority of India Act, 1994, the Trade Marks Act, 1999 and the Protection of Plant Varieties and Farmers\u2019 Rights Act, 2001 and certain other Acts have now effectively been rendered defunct with immediate effect. <\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'book antiqua', palatino, serif;\">Provided below is a table summarizing the changes introduced to the Patents Act, 1970 by virtue of passing of this Ordinance.<\/span><\/p>\n<table width=\"951\">\n<tbody>\n<tr>\n<td width=\"98\"><span style=\"font-family: 'book antiqua', palatino, serif;\"><strong>SECTION<\/strong><\/span><\/td>\n<td width=\"142\"><span style=\"font-family: 'book antiqua', palatino, serif;\"><strong>CHANGES INTRODUCED BY ORDINANCE<\/strong><\/span><\/td>\n<td width=\"355\"><span style=\"font-family: 'book antiqua', palatino, serif;\"><strong>OLD SECTION<\/strong><\/span><\/td>\n<td width=\"355\"><span style=\"font-family: 'book antiqua', palatino, serif;\"><strong>NEW SECTION<\/strong><\/span><\/td>\n<\/tr>\n<tr>\n<td style=\"text-align: left;\" width=\"98\"><span style=\"font-family: 'book antiqua', palatino, serif;\">Section 2(1)<\/span><\/td>\n<td style=\"text-align: left;\" width=\"142\"><span style=\"font-family: 'book antiqua', palatino, serif;\">(i) clause (a) shall be omitted;<\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">(ii) in clause (u), sub-clause (B) shall be omitted;<\/span><\/td>\n<td style=\"text-align: left;\" width=\"355\"><span style=\"font-family: 'book antiqua', palatino, serif;\">Definitions and Interpretations:<\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">&#8230;<\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">Section 2(1)(a): &#8220;Appellate Board&#8221; means the Appellate Board referred to in section 116.<\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">Section 2(u)(B): in relation to proceedings before the Appellate Board, prescribed by rules made by the Appellate Board; and<\/span><\/td>\n<td style=\"text-align: left;\" width=\"355\"><span style=\"font-family: 'book antiqua', palatino, serif;\">The mentioned clauses have been omitted from the Definitions and Interpretations provided under Section 2 of the Act<\/span><\/td>\n<\/tr>\n<tr>\n<td width=\"98\"><span style=\"font-family: 'book antiqua', palatino, serif;\">Section 52<\/span><\/td>\n<td width=\"142\"><span style=\"font-family: 'book antiqua', palatino, serif;\">The words \u201cAppellate Board or\u201d, wherever they occur, shall be omitted<\/span><\/td>\n<td width=\"355\"><span style=\"font-family: 'book antiqua', palatino, serif;\"><strong>52. Grant of patent to true and first inventor where it has been obtained by another in fraud of him &#8211;<\/strong><\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">(1) Where the patent has been revoked under section 64 on the ground that the patent was obtained wrongfully and in contravention of the rights of the petitioner or any person under or through whom he claims, or, where in a petition for revocation, the <span style=\"color: #ff0000;\"><u>Appellate Board or<\/u><\/span> court, instead of revoking the patent, directs the complete specification to be amended by the exclusion of a claim or claims in consequence of a finding that the invention covered by such claim or claims had been obtained from the petitioner, the <span style=\"color: #ff0000;\"><u>Appellate Board or<\/u><\/span> court may, by order passed in the same proceeding, permit the grant to the petitioner of the whole or such part of the invention which the <span style=\"color: #ff0000;\"><u>Appellate Board or<\/u><\/span> court finds has been wrongfully obtained by the patentee, in lieu of the patent so revoked or is excluded by amendment.<\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">(2) Where any\u00a0 such order is passed, the Controller shall on request by the petitioner made in the prescribed manner grant to him\u2014<\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">(i) in cases where the <span style=\"color: #ff0000;\"><u>Appellate Board or<\/u> <\/span>court permits the whole of the patent to be granted, a new patent bearing the same date and number as the patent revoked;<\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">(ii) in cases where the <span style=\"color: #ff0000;\"><u>Appellate Board or<\/u><\/span> court permits a part only of the patent to be granted, a new patent for such part bearing the same date as the patent revoked and numbered in such manner as may be prescribed:<\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">Provided that the Controller may, as a condition of such grant, require the petitioner to file a new and complete specification to the satisfaction of the Controller describing and claiming that part of the invention for which the patent is to be granted.<\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">(4) No suit shall be brought for any infringement of a patent granted under this section committed before the actual date on which such patent was granted.<\/span><\/td>\n<td width=\"355\"><span style=\"font-family: 'book antiqua', palatino, serif;\"><strong>52. Amendment of specification before <span style=\"text-decoration: underline; color: #ff0000;\">Appellate Board <\/span>or High Court<\/strong>.\u2014<\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">(1) In any proceeding before the <span style=\"color: #ff0000;\"><u>Appellate Board or<\/u><\/span> the High Court for the revocation of a patent, the <span style=\"color: #ff0000;\"><u>Appellate Board or<\/u><\/span> the High Court, as the case may be, may, subject to the provisions contained in section 59, allow the patentee to amend his complete specification in such manner and subject to such terms as to costs, advertisement or otherwise, as the <span style=\"color: #ff0000;\"><u>Appellate Board or<\/u><\/span> the High Court may think fit, and if, in any proceedings for revocation the <span style=\"color: #ff0000;\"><u>Appellate Board or<\/u><\/span> the High Court decides that the patent is invalid, it may allow the specification to be amended under this section instead of revoking the patent.<\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">(2) Where an application for an order under this section is made to the <span style=\"color: #ff0000;\"><u>Appellate Board or<\/u><\/span> the High Court, the applicant shall give notice of the application to the Controller, and the Controller shall be entitled to appear and be heard, and shall appear if so directed by the <span style=\"color: #ff0000;\"><u>Appellate Board or<\/u><\/span> the High Court.<\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">(3) Copies of all orders of the <span style=\"color: #ff0000;\"><u>Appellate Board or<\/u><\/span> the High Court allowing the patentee to amend the specification shall be transmitted by the <span style=\"color: #ff0000;\"><u>Appellate Board or<\/u> <\/span>the High Court to the Controller who shall, on receipt thereof, cause an entry thereof and reference thereto to be made in the register.<\/span><\/td>\n<td width=\"355\"><span style=\"font-family: 'book antiqua', palatino, serif;\"><strong>58. Amendment of specification before High Court<\/strong>.\u2014<\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">(1) In any proceeding before the or the High Court for the revocation of a patent, the High Court, subject to the provisions contained in section 59, allow the patentee to amend his complete specification in such manner and subject to such terms as to costs, advertisement or otherwise, as the High Court may think fit, and if, in any proceedings for revocation the High Court decides that the patent is invalid, it may allow the specification to be amended under this section instead of revoking the patent.<\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">(2) Where an application for an order under this section is made to the High Court, the applicant shall give notice of the application to the Controller, and the Controller shall be entitled to appear and be heard, and shall appear if so directed by the High Court.<\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">(3) Copies of all orders of the High Court allowing the patentee to amend the specification shall be transmitted by the High Court to the Controller who shall, on receipt thereof, cause an entry thereof and reference thereto to be made in the register<\/span><\/td>\n<\/tr>\n<tr>\n<td width=\"98\"><span style=\"font-family: 'book antiqua', palatino, serif;\">Section 59<\/span><\/td>\n<td width=\"142\"><span style=\"font-family: 'book antiqua', palatino, serif;\">The words \u201cthe Appellate Board or\u201d shall be omitted<\/span><\/td>\n<td width=\"355\"><span style=\"font-family: 'book antiqua', palatino, serif;\"><strong>59. Supplementary provisions as to amendment of application or specification<\/strong>.\u2014<\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">(1)No amendment of an application for a patent or a complete specification or any document relating thereto shall be made except by way of disclaimer, correction or explanation, and no amendment thereof shall be allowed, except for the purpose of incorporation of actual fact, and no amendment of a complete specification shall be allowed, the effect of which would be that the specification as amended would claim or describe matter not in substance disclosed or shown in the specification before the amendment, or that any claim of the specification as amended would not fall wholly within the scope of a claim of the specification before the amendment.<\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">(2) Where after the date of grant of patent any amendment of the specification or any other documents related thereto is allowed by the Controller or by the <span style=\"color: #ff0000;\"><u>Appellate Board or the<\/u><\/span> High Court, as the case may be,\u2014<\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">(a) the amendment shall for all purposes be deemed to form part of the specification along with other documents related thereto;<\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">(b) the fact that the specification or any other documents related thereto has been amended shall be published as expeditiously as possible; and<\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">(c) the right of the applicant or patentee to make amendment shall not be called in question except on the ground of fraud.<\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">(3) in construing the specification as amended, reference may be made to the specification as originally accepted.<\/span><\/td>\n<td width=\"355\"><span style=\"font-family: 'book antiqua', palatino, serif;\"><strong>59. Rectification of register by <u>Appellate Board<\/u> \u2014<\/strong><\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">(1) The <span style=\"color: #ff0000;\"><u>Appellate Board<\/u><\/span> may, on the application of any person aggrieved\u2014<\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">(a) by the absence or omission from the register of any entry; or<\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">(b) by any entry made in the register without sufficient cause; or<\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">(c) by any entry wrongly remaining on the register; or<\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">(d) by any error or defect in any entry in the register, make such order for the making, variation or deletion, of any entry therein as it may think fit.<\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">(2) In any proceeding under this section<span style=\"color: #ff0000;\"><span style=\"color: #000000;\"> the <\/span><\/span><span style=\"text-decoration: underline;\"><span style=\"color: #ff0000; text-decoration: underline;\">Appellate Board<\/span><\/span> may decide any question that may be necessary or expedient to decide in connection with the rectification of the register.<\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">(3) Notice of any application to the <span style=\"color: #ff0000;\"><u>Appellate Board<\/u><\/span> under this section shall be given in the prescribed manner to the Controller who shall be entitled to appear and be heard on the application, and shall appear if so directed by the Board.<\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">(4) Any order of the <span style=\"color: #ff0000;\"><u>Appellate Board<\/u><\/span> under this section rectifying the register shall direct that notice of rectification shall be served on the Controller in the prescribed manner who shall upon receipt of such notice rectify the register accordingly.<\/span><\/td>\n<td width=\"355\"><span style=\"font-family: 'book antiqua', palatino, serif;\"><strong>71. Rectification of register by High Court.\u2014<\/strong><\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">(1) The High Court may, on the application of any person aggrieved\u2014<\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">(a) by the absence or omission from the register of any entry; or<\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">(b) by any entry made in the register without sufficient cause; or<\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">(c) by any entry wrongly remaining on the register; or<\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">(d) by any error or defect in any entry in the register, make such order for the making, variation or deletion, of any entry therein as it may think fit.<\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">(2) In any proceeding under this section the High Court may decide any question that may be necessary or expedient to decide in connection with the rectification of the register.<\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">(3) Notice of any application to the High Court under this section shall be given in the prescribed manner to the Controller who shall be entitled to appear and be heard on the application, and shall appear if so directed by the High Court.<\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">(4) Any order of the High Court under this section rectifying the register shall direct that notice of rectification shall be served on the Controller in the prescribed manner who shall upon receipt of such notice rectify the register accordingly.<\/span><\/td>\n<\/tr>\n<tr>\n<td width=\"98\"><span style=\"font-family: 'book antiqua', palatino, serif;\">Section 76<\/span><\/td>\n<td width=\"142\"><span style=\"font-family: 'book antiqua', palatino, serif;\">The words \u201cor Appellate Board\u201d shall be omitted.<\/span><\/td>\n<td width=\"355\"><span style=\"font-family: 'book antiqua', palatino, serif;\"><strong>76. Officers and employees not to furnish information, etc.\u2014<\/strong><\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">An officer or employee in the patent office shall not, except when required or authorised by this Act or under a direction in writing of the Central Government or <span style=\"color: #ff0000;\"><u>Appellate Board or<\/u><\/span> the Controller or by order of a court,\u2014<\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">\u00a0(a) furnish information on a matter which is being, or has been, dealt with under this Act ; or<\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">(b) prepare or assist in the preparation of a document required or permitted by or under this Act , to be lodged in the patent office; or<\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">\u00a0(c) conduct a search in the records of the patent office.<\/span><\/td>\n<td width=\"355\"><span style=\"font-family: 'book antiqua', palatino, serif;\"><strong>76. Officers and employees not to furnish information, etc.\u2014<\/strong><\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">An officer or employee in the patent office shall not, except when required or authorised by this Act or under a direction in writing of the Central Government or the Controller or by order of a court,\u2014<\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">\u00a0(a) furnish information on a matter which is being, or has been, dealt with under this Act ; or<\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">(b) prepare or assist in the preparation of a document required or permitted by or under this Act , to be lodged in the patent office; or<\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">\u00a0(c) conduct a search in the records of the patent office.<\/span><\/td>\n<\/tr>\n<tr>\n<td width=\"98\"><span style=\"font-family: 'book antiqua', palatino, serif;\">Section 113<\/span><\/td>\n<td width=\"142\"><span style=\"font-family: 'book antiqua', palatino, serif;\">(i) in sub-section (1),\u2013\u2013<\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">(A) the words \u201cthe Appellate Board or\u201d, wherever they occur, shall be omitted;<\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">(B) the words \u201cas the case may be\u201d shall be omitted;<\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\">(ii) in sub-section (3), the words \u201cor the Appellate Board\u201d shall be omitted.<\/span><\/td>\n<td width=\"355\"><span style=\"font-family: 'book antiqua', palatino, serif;\"><strong>113. Certificate of validity of specification and costs of subsequent suits for infringement thereof.\u2014<\/strong><\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\"><strong>(1) <\/strong>If in any proceedings before the <span style=\"color: #ff0000;\"><u>Appellate Board or<\/u><\/span> a High Court for the revocation of a patent under section 64 and section 104, as the case may be, the validity of any claim of a specification is contested and that claim is found by the <span style=\"color: #ff0000;\"><u>Appellate Board or<\/u><\/span> the High Court to be valid, the <span style=\"text-decoration: underline;\"><span style=\"color: #ff0000; text-decoration: underline;\">Appellate Board or the<\/span><\/span> High Court may certify that the validity of that claim was contested in those proceedings and was upheld.<\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\"><strong>\u00a0<\/strong><\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif;\"><strong>(3) <\/strong>Nothing contained in this section shall be construed as authorising the courts <span style=\"color: #ff0000;\"><u>or the Appellate Board<\/u><\/span> hearing appeals from decrees or orders in suits for infringement or petitions for revocation, as the case may be, to pass orders for costs on the scale referred to therein.<\/span><\/td>\n<td width=\"355\"><span style=\"font-family: 'book antiqua', palatino, serif;\"><strong>113. Bar of jurisdiction of courts, etc.\u2014<\/u><\/strong><u>No court or other authority shall have or, be entitled to, exercise any jurisdiction, powers or authority in relation to the matters referred to in sub-section (2) of section 117A or section 117D.<\/u><\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif; color: #ff0000;\"><strong><u>117D. Transfer of pending proceedings to Appellate Board.\u2014<\/u><\/strong><u>All cases of appeals against any order or decision of the Controller and all cases pertaining to revocation of patent other than on a counter-claim in a suit for infringement and rectification of register pending before any High Court, shall be transferred to the Appellate Board from such date as may be notified by the Central Government in the Official Gazette and the Appellate Board may proceed with the matter either de novo or from the stage it was so transferred.<\/u><\/span><br \/>\n<span style=\"font-family: 'book antiqua', palatino, serif; color: #ff0000;\"><strong><u>\u00a0117H.
