LG Electronics Inc., the South Korean multinational electronics major has filed three trademark application for the marks Flex, Foldi and Duplex under class 09, for foldable smartphones. The new smartphones are likely to be launched in the upcoming year in order to compete with Samsung\u2019s Galaxy F.<\/p>\n<h2><strong>INDIAN TRADEMARK UPDATES<\/strong><\/h2>\n<h3><strong>AAJ TAK Wins Trademark Battle<\/strong><\/h3>\n<p>Living Media India Limited (India Today Group) filed for a permanent injunction restraining Mandeep Kaur from infringement and passing off trademark \u2018AAJ TAK\u2019 or any other mark deceptively similar to India Today\u2019s registered trademark in relation to magazine, newspaper, journals, etc. India Today is one of the major media corporations in the country and is the registered trademark holder of the mark \u2018AAJ TAK\u2019 since 1995. India Today recently came to know of Mandeep Kaur who claims to own, print and publish the fortnightly magazine \u2018AAJ TAK AAMNE SAAMNE\u2019 and also is the owner of the domain <a href=\"http:\/\/www.aajtakaamnesaamne.com\" target=\"_blank\" rel=\"noopener\">www.aajtakaamnesaamne.com<\/a>. India Today sent cease and desist notices to Mandeep Kaur, but he failed to act upon the notice and continued the use of the infringing trademark. The Court opined that India Today has clearly established the infringement and the acts of Mandeep Kaur are not bonafide. Therefore, a decree of permanent injunction is passed in favour of India Today. Further, India Today is also entitled to damages of Rs. 1 lakh.<\/p>\n<h2><strong>INTERNATIONAL TRADEMARK UPDATES<\/strong><\/h2>\n<h3><strong>Trademark Infringement over a Candle<\/strong><\/h3>\n<p>Claridge, a popular 5-star hotel based out of London, filed a trademark infringement suit against Claridge Candles, a candle manufacturing entity incorporated in England, for infringing its registered trademark. Claridge has claimed in the suit that it has \u201csuffered damage and integrity to its trademark\u201d and the use of the letter \u2018C\u2019 by Claridge Candles is likely to cause confusion amongst the consumers and is likely to dilute the \u2018distinctiveness\u2019 of its trademark. Claridge has also requested an order for Claridge Candles to withdraw their trademark application. An order is yet to pass.<\/p>\n<h3><strong>A Surname Can be Trademarked?<\/strong><\/h3>\n<p>The heirs of Phyllis Schlafly, the US activist and lawyer, known for her conservative views, lost an appeal against a craft brewery in Missouri called Saint Louis Brewery LLC from trademarking the name \u2018Schlafly\u2019. \u00a0The heirs claimed that trademarking \u2018Schlafly\u2019 for beer will hurt their reputation by being associated with alcohol. The U.S. Federal Circuit Court of Appeals however ruled in favour of the brewery, stating that surnames can be trademarked if the name has acquired a \u2018secondary meaning\u2019 and \u2018distinctiveness\u2019.<\/p>\n<h2><strong>TRADEMARK BRAND LICENSING UPDATES<\/strong><\/h2>\n<h3><strong>Discovery Brand in India<\/strong><\/h3>\n<p>Discovery Inc. has appointed Black White Orange Brands Pvt. Ltd. as their licensing agent in India. As the licensing agent, Black White Orange will represent and manage Discover\u2019s extensive portfolio, including major brands such as Animal Planet, Discovery Adventures and more. The agency will closely work with Discovery to explore licensing deals and partnerships to venture into apparel, home d\u00e9cor, electronics, travel and adventure gear, etc.<\/p>\n<h2><strong>GEOGRAPHICAL INDICATION UPDATES<\/strong><\/h2>\n<h3><strong>Himachal Pradesh Government Grows Vigilant on Issues of GI violations<\/strong><\/h3>\n<p>Himachal Pradesh has woken up to the threat of imitation and duplication of its geographically protected products. A policy is formulated for the registration and protection of geographical indications of goods in Himachal and a state-level committee has been set up. The Committee is entrusted to regulate the registered GIs and to devise a preventive mechanism to tackle cases of violations.
