Divya Gontia, filed a public interest litigation alleging that online platforms consist of vulgarity and crude language content, which must be regulated.<br \/>\nIn the petition, she cited \u2018Gandi Baat\u2019\u00a0on the online platform ALT Balaji and\u00a0\u2018Sacred Games\u2019\u00a0on Netflix as examples of shows having \u201cvulgar content\u201d and further, requested for the setting up of a pre-screening committee to regulate online shows and movies.<\/p>\n<h3><strong>Prithvi Shaw&#8217;s Management Agency Claims INR 1 Crore from Freecharge and Swiggy<\/strong><\/h3>\n<p>Baseline Ventures, the sports marketing team managing national cricketer Prithvi Shaw, has sent cease and desist notices to FreeCharge and Swiggy seeking a sum of Rs. 1 crore each, as compensation for using Shaw\u2019s name in their promotions.\u00a0 Upon Prithvi\u2019s maiden Test Cricket century Swiggy posted creatives on social media stating &#8220;Firsts we&#8217;ll remember forever: First bite of Rasmalai, First innings of Prithvi Shaw&#8221;.<br \/>\nBaseline Ventures alleged that such usage by the like of Swiggy and FreeCharge are riding on Shaw&#8217;s name and fame without the company&#8217;s authorization and violating Prithvi Shaw\u2019s exclusive rights.<\/p>\n<h3><strong>Court Rejects Raymond Chairman Gautam Singhania&#8217;s Application Seeking Injunction Against a Book His Father is Writing<\/strong><\/h3>\n<p>A suit was filed in September by Raymond Group Chairman Gautam Singhania, seeking an injunction against a tell-all book his estranged father\u00a0Dr. Vijaypat Singhania\u00a0is writing, alleging that its contents were \u201cdefamatory to him as well as his family\u201d.<br \/>\nHowever, the publishers and Vijaypat\u2019s lawyers argued that the content claiming to be defamatory has not been proved. Further they, stated that the book was \u201cstill in process,\u201d and therefore, the allegations in the suit were premature. The publishers informed the court that the book was not a biography, but an autobiography. The court, accepting these arguments, observed that the family members were involved in a \u201cpublic fight\u201d, and rejected Gautam\u2019s application.<\/p>\n<h2><strong>INTERNATIONAL COPYRIGHT NEWS UPDATE<\/strong><\/h2>\n<h3><strong>Sony Sues Individual for Copyright Infringement of PS4<\/strong><\/h3>\n<p>Sony has filed a suit in a California court against an individual for infringing the copyright relating to PlayStation (PS) software and games, as well as selling \u201cjailbroken\u201d consoles and services. Sony claimed that Eric David Scales, doing business as Blackcloak13, had marketed and sold jailbroken PS4 consoles which contain pirated copies of PS4-compatible games on eBay, and had also offered jailbreaking services for PS4 consoles.<br \/>\nThe act of \u201cjailbreaking\u201d refers the removal of various constraints applied by a device, including those preventing a console from playing pirated copies of video games.<br \/>\nIn its suit, Sony described the copyright registrations obtained for its authorized games and the PlayStation code, and the specific measures designed to prevent running of unauthorized games on PS consoles. Sony claimed that the act of jailbreaking circumvented the technological protection measures which usually prevent consoles from playing pirated copies of video games, and thus violated the Digital Millennium Copyright Act (DMCA). Sony is seeking an injunction preventing Blackcloak13 from selling the infringing products and services, the delivery of all disputed devices for destruction, all profits received by Blackcloak13 and the statutory damages and costs incurred.<\/p>\n<h3><strong>Court Denies Spotify\u2019s Request to Dismiss a $321 Million Copyright Infringement Lawsuit<\/strong><\/h3>\n<p>A Federal Court in Tennessee, US, has denied Spotify\u2019s request to dismiss a massive copyright infringement lawsuit worth hundreds of millions in potential damages.<br \/>\nThe suit was filed in July 2017 by Bluewater Music Services Corporation, an independent publisher and copyright administration company. The suit alleges that Spotify willfully infringed on 2,339 copyrighted works, including Sam Gay\u2019s \u201810,000 Pieces\u2019 and Bob Morrison\u2019s \u2018You\u2019d Make an Angel Want To Cheat.\u2019 Bluewater claims it had terminated Spotify\u2019s license to reproduce and stream the works in November 2016, and demanded the company stop streaming the specific works. Bluewater claims that Spotify failed to negotiate a direct mechanical license, and either failed to pay proper mechanical royalties, or paid no royalties at all. Bluewater has sought a maximum statutory damage award of USD 150,000 for each infringed work, for a total of USD 321.3 million.<\/p>\n<h2><strong>MERCHANDISING AND LICENSING NEWS<\/strong><\/h2>\n<h3><strong>Video Game Franchise Mega Man Being Made into Live Action Movie<\/strong><\/h3>\n<p>Capcom, the publisher of the popular video game Mega Man, has announced a partnership with 20<sup>th<\/sup> Century Fox to create a live action version of the game. The movie adaptation will also involve Chernin Entertainment, most well associated with the\u00a0<em>Planet of The Apes<\/em>\u00a0reboot series as well as action comedies\u00a0<em>The Spy<\/em>\u00a0and\u00a0<em>Heat. <\/em>The game, which pits players against seven distinct major enemies, has spawned over 70 games in total as well as half a dozen cartoon shows.<br \/>\nThe announcement follows closely on the heels of a critically acclaimed\u00a0<em>Mega Man 11<\/em>\u00a0release on console and computer. Capcom Japan has not yet announced a projected release date for the\u00a0<em>Mega Man<\/em>\u00a0film.<\/p>\n<h3><strong>DistroKid Receives Silversmith Capital Funding<\/strong><\/h3>\n<p>Music distributor DistroKid announced this week that it would be receiving a significant investment from Silversmith Capital, a Boston-based growth equity company. DistroKid distributes music to platforms such as Spotify, Apple Music, iTunes, and Deezer and is used by over 250,000 music artists. Unlike most distributors who take a percentage of music royalties in exchange for services rendered, DistroKid charges artists a low flat fee on an annual subscription basis.
