The marks have been filed by the Samsung\u2019s sister concern Samsung Electronics under class 9, with the description \u2018Televisions; Digital signage, Monitors for large format displays, Television sets\u2019. It is interesting to note that the applications have been filed with a priority date of 3<sup>rd<\/sup> August 2018, as an international application with the base country being UK.<\/p>\n<h2><strong>INDIAN TRADEMARK UPDATES<\/strong><\/h2>\n<h3><strong>Tata Financial Service Infringement &amp; Passing-off \u00a0<\/strong><\/h3>\n<p>Tata Sons Ltd had filed a suit against Krishna Kumar &amp; Ors for trademark and domain name infringement with respect to the use of the mark Tata Finserve Pvt Ltd and the impugned domain <a href=\"http:\/\/www.tatafinserve.com\" target=\"_blank\" rel=\"noopener\">www.tatafinserve.com<\/a>. TATA which is India\u2019s oldest and largest conglomerate also provides for financial services under the domain names <a href=\"http:\/\/www.tatacapitalfinancialservices.com\" target=\"_blank\" rel=\"noopener\">www.tatacapitalfinancialservices.com<\/a> and <a href=\"http:\/\/www.tatacapital.com\" target=\"_blank\" rel=\"noopener\">www.tatacapital.com<\/a>. It is also stated in the suit that the website hosted on the impugned domain name bears a striking resemblance to TATA\u2019s websites in terms of layout, prominent color scheme and manner of depiction of services\/products offered. The Court passed an ex-parte order restraining Krishna Kumar &amp; Ors from using any similar marks and also ordered the domain name to be transferred to TATA. Further, since TATA suffered immense loss to goodwill and reputation, the Court also ordered Krishna Kumar to pay pecuniary damages of a sum of INR 10 Lacs.<\/p>\n<h2><strong>INTERNATIONAL TRADEMARK UPDATES<\/strong><\/h2>\n<h3><strong>Ferrari Sued for Infringement<\/strong><\/h3>\n<p>Ferrari N.V., the luxury Italian car manufacturer is in legal trouble over trademark infringement. Chad McQueen, son of legendary American actor Steve McQueen, has filed an infringement suit claiming that the Italian car manufacturer is using his father\u2019s image for the car without authorization. The suit claims that Ferrari has been selling special edition cars under the name \u2018The McQueen\u2019, which are priced at a higher range than the other Ferrari cars. Chad McQueen has filed for trademark infringement, false endorsement and misappropriation of the right of publicity claiming $1 million in compensatory damages, and $2 million in statutory damages per registered trademark.<\/p>\n<h3><strong>Bob Dylan in Legal Trouble <\/strong><\/h3>\n<p>Heaven\u2019s Door Spirit, an American spirit manufacturer, co-owned by the famous singer Dob Dylan is hit with a trademark infringement suit. Heaven Hill Distillery, an American company has filed the suit against Heaven\u2019s Door Spirit, claiming the logo used by Dylan\u2019s Heaven\u2019s Door to be confusingly similar to theirs. The suit has been filed in the U.S. District Court in Louisville but a cease and desist notice has already been sent to Heaven\u2019s Door prior to the suit filing. However, Heaven\u2019s Door refused all the claims made by Heaven Hill and stated that they \u2018did not believe a likelihood of confusion would result, and advised they did not intend to change the infringing mark or otherwise comply with the demands\u2019.<\/p>\n<h2><strong>TRADEMARK LICENSING UPDATES<\/strong><\/h2>\n<h3><strong>India Licensing Expo 2018 in Mumbai<\/strong><\/h3>\n<p>India Licensing Expo 2018, second edition of the Country\u2019s largest brand licensing platform is all set to commence on 23<sup>rd<\/sup> August in Mumbai.
