But I also believe in fair use, public domain, and especially transformation\u201d &#8211; <\/em>David Shields<\/p>\n<h2>Indian Copyrights and Entertainment Law Updates<\/h2>\n<h3>Mahesh Babu summoned by Nampally Sessions Court in Srimanthudu Copyright case<\/h3>\n<p>Tollywood superstar Mahesh Babu has been summoned by the Nampally Sessions Court, Hyderabad in a copyright infringement suit filed by Novelist M Sarat Chandra. Sarath Chandra is alleging that Mahesh Babu\u2019s 2015 box office blockbuster Srimanthudu is based on his novel \u2018Chachchenta Prema\u2019 that was published in a magazine in 2012. Based on Sarat\u2019s petition the Court has asked the actor Mahesh Babu, director Koratala Siva and producer Y Naveen to appear before the court in person on 3<sup>rd<\/sup> March. The trio filed a petition before the Sessions Court seeking exemption from appearing in the Court. The Court on Monday refused to grant exemption from appearing before the court in this case and has directed them to appear before the court for examination during the next hearing.<\/p>\n<h2>International Copyright and Entertainment Law Updates<\/h2>\n<h3>Pirate Bay liable for copyright infringement says ECJ<\/h3>\n<p>The European Court of Justice recently held that operating and managing an online platform for sharing copyrighted content amounts to copyright infringement. The case revolves around the torrent site Pirate Bay, which allows users to upload and share films, music, videos, games, and other content. The court found that even though the works are shared online by the users, the operators of the online platform play an essential role in making those works available to public. The operators in fact index the torrent files so that, other users can easily identify the infringing works. Moreover, the site offers a search engine that allows users to search for infringing works based on categories. This ruling might not have much effect on Pirate Bay as the site is already blocked across Europe, however, it will have a significant impact on similar platforms.<\/p>\n<h3>Australian Parliament passes the Copyright Amendment (Disability Access and Other Measures) Bill.<\/h3>\n<p>The Australian parliament has passed amendments to the Copyright Act, 1968 to provide fair use provisions for access to copyright materials by those with disabilities, along with protecting educational institutions, libraries and archives from copyright infringement. The reforms are intended to improve access to copyrighted materials for people with a vision, hearing or intellectual disability.<\/p>\n<h3>ACE formed to curb piracy on a global scale.<\/h3>\n<p>30 companies including Amazon, AMC Networks, Star India, BBC Worldwide, Sony Pictures Entertainment, HBO, Hulu, Lionsgate, Metro-Goldwyn-Mayer (MGM) and Netflix have come together to form Alliance for Creativity and Entertainment (ACE) to counter piracy. To curb piracy, ACE will be working with law enforcement and content protection organizations in various countries besides working closely with other stakeholders.<\/p>\n<h2>Entertainment Licensing and Merchandising Updates<\/h2>\n<h3><strong>Cars 3 signs most brand deals for an animation film in India<\/strong><\/h3>\n<p>The Indian unit of Walt Disney Co., has signed up with forty (40) brands for its newly released film Cars 3, making it the highest number of brand partnerships for an animation film in India. Various brands including Amazon, Hamleys, Mattel, Myntra, Max, Pantaloons, Bioworld, Crocs, Bata, Titan, D\u2019D\u00e9cor are among the list of partners. The deals include a one-time license fee as well as royalties on merchandise sold. Previously, another Disney-Pixar film Finding Dory had bagged sixteen (16) brands.<\/p>\n<h2>Entertainment Trademark Updates<\/h2>\n<h3>SPLINTER CELL by Ubisoft<\/h3>\n<p>The game developer Ubisoft has recently filed a trademark application before the USPTO for the mark SPLINTER CELL for multiplayer computer games, television programs, sports competitions and online portal for gaming all falling under Class 41. The mark was filed as a proposed to be used mark indicating that the seventh edition of Splinter Cell game is under development. Ubisoft had earlier registered the marks SPLINTER CELL CONVICTION, SPLINTER CELL CHAOS THEORY and SPLINTER CELL DOUBLE AGENT with the United States Trademarks and Patent Office.<\/p>\n<h2>BIP Copyright and Entertainment Tip of the Week<\/h2>\n<h3>Film stars and Copyright Infringement<\/h3>\n<p>Film stars must take appropriate steps to ensure that they are not liable for copyright infringement while acting in any films or videos. The Artist may take the following steps:<\/p>\n<ol>\n<li>Include appropriate covenants and representation in agreements;<\/li>\n<li>Place well drafted disclaimers in materials relating to film; and<\/li>\n<li>Other business and legal measures<\/li>\n<\/ol>\n<p>Having said that, since most actors are also producers, Film Stars must ensure that any claims of copyright infringement are addressed appropriately to reduce chances of them landing in courts.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The post examines key copyright and trademark cases, including the Srimanthudu copyright suit and Pirate Bay\u2019s infringement ruling.
