The three international publishers had in addition alleged that the photocopy shop was causing huge financial losses as the shop engaged in selling photocopies of parts of their books to students and therefore there was a dip in sales of their text books. The Delhi High Court, however, on December 9, 2016, had allowed the shop to photocopy the copyrighted material for educational use under the Indian Copyright law. The three international publishers now have decided to put an end to this legal battle by deciding to withdraw the copyright suit against the sale of photocopied pages of their books in Delhi University.<\/p>\n<h3 style=\"text-align: justify;\"><strong>Entertainment Licensing News and Updates<\/strong><\/h3>\n<h4 style=\"text-align: justify;\">Shemaroo Entertainment enters into content licensing deal with Vuclip\u2019s Viu<\/h4>\n<p style=\"text-align: justify;\">Shemaroo Entertainment has entered\u00a0into a content licensing deal with Viu, Vuclip\u2019s premier OTT video on demand service. Videocon d2h plans to bring in its next generation connected STBs, that would have pre-installed OTT and utility applications that can be accessed by users with broadband or Wi-Fi-connection on their TV sets.<\/p>\n<h4 style=\"text-align: justify;\">Amazon Prime Video signs a long-term exclusive deal with Lionsgate<\/h4>\n<p style=\"text-align: justify;\">Amazon has signed a long-term exclusive deal with Lionsgate to broadcast Lionsgate\u2019s films, television episodes and upcoming new releases. This deal will give Amazon access to films such as La La Land, Deepwater Horizon, etc which would otherwise not be available through the traditional Indian satellite players or other pay-TV providers.<\/p>\n<h4 style=\"text-align: justify;\">Batman Card Game Hits Stores<\/h4>\n<p style=\"text-align: justify;\">Warner Brothers has signed a licensing deal with Crypotozic Entertainment on behalf of DC Entertainment to release a card game based on the\u00a0Batman animation series, &#8220;Almost Got &#8216;Im&#8221;. Players take on the roles of various DC Super-Villains to fight Batman, oblivious to the fact that one of them is secretly Batman in disguise.<\/p>\n<h4 style=\"text-align: justify;\">Hello Kitty Character Merchandizing takes another step forward<\/h4>\n<p style=\"text-align: justify;\">The Japanese character, Hello Kitty, is one of the most popular and successful characters that has been extensively merchandized. Its yearly merchandize value is estimated to be upwards of six billion dollars. Sanrio, its owner, has recently collaborated with Lazy Oaf to take the character into denim skirts, jackets, and other accessories.<\/p>\n<h4 style=\"text-align: justify;\">Pink Panther Collection as part of Fashion Comic Project<\/h4>\n<p style=\"text-align: justify;\">Pink Panther designs have been show cased as part of the Fashion Comic Project in Europe. Character World, which sells curtains, cushion covers, and other products are expecting a surge as its licensor is set to launch new content. Merchandizing success is linked with staying relevant, and ongoing programs around characters are the key to continuing demand in the market.<\/p>\n<h3 style=\"text-align: justify;\"><strong>International Entertainment Law News and Updates<\/strong><\/h3>\n<h4 style=\"text-align: justify;\">Swedish Court Blocks Pirate Bay<\/h4>\n<p style=\"text-align: justify;\">The Swedish Court of Patent and Market Appeal issued an injunction recently asking an Internet Access Provider to block Pirate Bay. The Court reversed the decision of the lower court stating that the Swedish law and the EU law permitted such an injunction. Universal, Sony and Warner Bros. were among the applicants for the injunction.<\/p>\n<h4 style=\"text-align: justify;\">Will Mega Upload&#8217;s founder be extradited?<\/h4>\n<p style=\"text-align: justify;\">Kim Dotcom and other founders of Mega Upload, the infamous file sharing website, are facing an uphill task to prevent extradition to USA. Readers of INTELLEPEDIA will recall that Kim Dotcom and his colleagues were arrested by the New Zealand police in a dramatic two helicopter, commando like operation. Though the extradition plea did not hold water based on copyright infringement, an appeal judge in New Zealand recently held that Kim and his colleagues can be extradited to USA based on grounds of conspiracy to defraud.<\/p>\n<p style=\"text-align: justify;\">Kim and his team will be appealing, but the future does not seem very bright for them. Once they are moved to a US Court, their fate many scholars believe is more or less given.<\/p>\n<h4 style=\"text-align: justify;\">Counterfeiters Cost US 600 Billion Dollars?<\/h4>\n<p style=\"text-align: justify;\">The Republic has reported that the Commission on the Theft of American Intellectual Property believes that counterfeiting causes losses to the tune of six hundred billion dollars to the United States. Trade Secret theft loss is estimated to be upto 540 million dollars. It seems that losses from piracy are rising substantially, at least on paper.<\/p>\n<p style=\"text-align: justify;\">In the said backdrop, one wonders what the losses to India would be from counterfeiting and piracy.<\/p>\n<h4 style=\"text-align: justify;\">Nintendo Sues Marycar for video game copyright infringement<\/h4>\n<p style=\"text-align: justify;\">Nintendo has sued Marycar, a company that rents out Go-Karts for copyright infringement. Among other claims, Nintendo is alleging that Marycar is renting copyrighted dresses of its video game characters such as Super Mario without a license. The company is also alleging misappropriation of character names and trade mark infringement.<\/p>\n<p style=\"text-align: justify;\">The recent Rangoon case around character rights infringement reflects what is in store for character use and merchandizing in India.<\/p>\n<h3 style=\"text-align: justify;\"><strong>Copyright Licensing<\/strong><\/h3>\n<h4 style=\"text-align: justify;\">Great Minds Fails; Creative Commons Prevails<\/h4>\n<p style=\"text-align: justify;\">Great Minds sued FedEx for photocopying its content, which was made available under a Creative Commons License NC SA 4.0. The New York District Court while dismissing the suit held that FedEx&#8217;s act of copying the content for non-commercial use of schools was permitted by the license, and did not amount to copyright infringement. The Court stated that a CC licensee can exercise its rights under the license with the help of a third party, FedEx in this case.<\/p>\n<p style=\"text-align: justify;\">Creative commons has more than one billion works under different licenses, and though the movement has caught up very well in other countries, we are yet to see large volumes from India.<\/p>\n<h3 style=\"text-align: justify;\"><strong>Government Updates<\/strong><\/h3>\n<h4 style=\"text-align: justify;\">Ministry of I &amp; B makes it mandatory for private broadcasters to share live broadcasting signals of sporting events with Doordarshan<\/h4>\n<p style=\"text-align: justify;\">Information and Broadcasting Ministry has declared Commonwealth Games, Asian Games, Summer and Special Olympics, Paralympics and some tennis, hockey, matches of Davis Cup, Grand Slam tournaments (Men\u2019s and Women\u2019s Singles finals, all matches featuring Indian players in quarter-finals onwards and all such matches featuring Indian players in men\u2019s, Women\u2019s Doubles or Mixed Doubles from quarter-finals onwards) and football as sporting events of \u201cnational importance\u201d and has made it mandatory for\u00a0private broadcasters to share live broadcasting signals of such sporting events with Prasar Bharati simultaneously, for re-transmitting the same on its terrestrial networks and direct-to-home network under the Sports Broadcasting Signals (Mandatory Sharing with Prasar Bharati) Act, 2007.<\/p>\n<h4 style=\"text-align: justify;\">TRAI issues recommendations on Spectrum Usage Charges<\/h4>\n<p style=\"text-align: justify;\">Telecom Regulatory Authority of India (TRAI) based on the written comments and counter comments for the consultation paper on &#8220;Spectrum Usage Charges and Presumptive Adjusted Gross Revenue for Internet Service Providers and Commercial Very Small Aperture Terminal Service Providers\u201d finalised and released its recommendations on Spectrum Usage Charges recently.<\/p>\n<h4 style=\"text-align: justify;\">TRAI notifies the\u00a0tariff regulations for governing the broadcast sector<\/h4>\n<p style=\"text-align: justify;\">The Telecom Regulatory Authority of India (TRAI) through recent\u00a0notifications has mandated several key consumer-friendly moves to be undertaken by the broadcast sector. Among these is a move that requires\u00a0broadcasters to declare the maximum retail price per month of their a la carte pay channels and separate bouquet formation of pay channels and free-to-air channels.<\/p>\n<p style=\"text-align: justify;\">According to the new regulation, subscribers will have to pay a maximum subscription fee of \u20b9130 a month, excluding taxes, to distributors for access to the initial 100 Standard Definition (SD) channels. Beyond that, additional channels will be available in slabs of 25 SD channels for an amount not exceeding \u20b920 excluding taxes.
