The recent entertainment IP legal battle pertains to Beyonc\u00e9 suing Feyonc\u00e9 Inc, for sale of T-shirts, hoodies, tank tops and other clothing items, and engagement mugs bearing words “Feyonc\u00e9\u201d confusingly similar to her registered mark \u201cBeyonc\u00e9\u201d and bearing the famous lines \u201cHe put a ring on it\u201d from her most popular song \u201cSingle Ladies\u201d.<\/p>\n
Beyonc\u00e9 brought a suit for injunction against the Defendants Feyonc\u00e9 Inc – a Texas based company involved in selling online merchandise, for willful trademark infringement, unfair competition, trademark dilution, etc., Beyonce has claimed the willful infringement and use of Beyonc\u00e9 goodwill and notoriety by the company. Beyonc\u00e9 in the suit claimed that Feyonc\u00e9 mark was just a misspelling of the word “fianc\u00e9,”which refers to\u00a0Beyonc\u00e9’s 2008 hit, “Single Ladies.” Beyonc\u00e9 in the suit described Feyonc\u00e9’s conduct as intentional, fraudulent, malicious, willful and wanton.<\/p>\n
It is further alleged in the suit that, Feyonc\u00e9 tried to trademark “Feyonc\u00e9” twice, both with and without the accent over the “e.” Beyonc\u00e9 claimed that the Feyonc\u00e9 have adopted a nearly identical mark to falsely designate Beyonc\u00e9 as the source of Feyonc\u00e9\u2019s merchandising.<\/p>\n
This suit comes after Beyonc\u00e9 asking Defendant Feyonc\u00e9 to cease and desist from selling infringing merchandise, despite which Defendant Feyonc\u00e9 have robustly marketed the infringing merchandise on their website. As a result of which Beyonc\u00e9 filed a suit claiming infringement of her trademark and causing confusion to consumers.<\/p>\n
Celebrities invest\u00a0heavily in the promotion of\u00a0their name, brand name or image. Hence, time and again we see them putting their foot down to exercise their legal rights against third parties taking unauthorised advantage of their hard-earned fame.\u00a0 In this suit, Beyonc\u00e9 has sought unspecified damages based on her assertion that she has invested considerably in creating, maintain and promoting the goodwill associated with her name and trademarks.<\/p>\n
This case is not a first for Beyonc\u00e9. In an earlier instance Beyonc\u00e9, Kanye West and other artists had brought forth a suit for infringement of trademarks against a well known fashion label. The suit was later amicably resolved. In this instance,\u00a0a\u00a0T-shirt of the fashion label featured an image of Beyonc\u00e9 wearing a dark magenta ski mask on the front and the phrase, “A Diva Is A Female Version Of A Hustler\u201d,\u00a0reflecting\u00a0Beyonc\u00e9’s song “Diva” which includes the lyrics, “Diva is a female version of a hustla.” Further, a garment hangtag used the name “Cayonce\u201d which allegedly was to confuse the consumers.<\/p>\n
What will happen in this case is yet to be seen. However, if the suit proceeds Beyonc\u00e9 would probably be singing \u201cI would like to thank the judges for picking me\u2026\u201d<\/p>\n
