{"id":35280,"date":"2016-04-04T16:00:29","date_gmt":"2016-04-04T10:30:29","guid":{"rendered":"http:\/\/localhost\/one\/sinapse\/?p=35280"},"modified":"2025-06-09T11:55:59","modified_gmt":"2025-06-09T06:25:59","slug":"trademark-office-mass-abandonment-public-notice-india","status":"publish","type":"post","link":"https:\/\/www.bananaip.com\/intellepedia\/trademark-office-mass-abandonment-public-notice-india\/","title":{"rendered":"Trade Mark Office issues public notice regarding mass abandonment of applications"},"content":{"rendered":"<p style=\"text-align: justify;\">Following the <em><a href=\"https:\/sinapse\/en-masse-abandonment-trade-mark-applications-indian-trade-mark-office\/\" target=\"_blank\" rel=\"noopener noreferrer\">en masse<\/a><\/em> abandonment of trade mark applications the office of the CGPTD has issued a public notice, today 4<sup>th<\/sup> April, 2016, \u2018relating to \u201ctreating applications as abandoned\u201d in want of reply to Examination Report containing office objection within prescribed period.\u2019<\/p>\n<p style=\"text-align: justify;\">In the notice it is stated that as per the requirements of the Trademarks Act, 1999 all such application where the examination responses, to the examination reports of such applications, were not received within the 30 days time period have been treated as abandoned. Further it goes on to justify the actions of the Office by stating that \u201cthe examination reports were already posted on the official website and were also sent to the applicants or their authorized agents concerned individually.\u201d<\/p>\n<p style=\"text-align: justify;\">The notice proceeds to say that the Trade Marks Office has been in receipt of some complaints (we\u2019re assuming a plethora of complaints) regarding such abandonment, where either the responses were submitted but not considered or complaints where the examination reports were not received at all by the applicants or their agents. In response to such complaints and \u201cin the interest of justice\u201d the Trade Mark Office has stated that following:<\/p>\n<p style=\"text-align: justify;\">\u201c<em>It is notified to all concerned that in case any applicant or his authorised agent considers that his\/her application has been erroneously treated as abandoned, he\/she should send a representation with all details along with sufficient documentary evidence substantiating his\/her case. <\/em><\/p>\n<p style=\"text-align: justify;\"><em>All such representations and reply to examination reports, if any, should be submitted to office of CGPDTM by email at <strong><a href=\"mailto:abhishek.p@nic.in\">abhishek.p@nic.in<\/a> , cc: <a href=\"mailto:sdojha.tmr@nic.in\">sdojha.tmr@nic.in<\/a> <\/strong>before<strong> 30\/04\/2016<\/strong>.
