Pirate Bay was founded in 2003 by the anti-copyright organisation known as “The Piracy Bureau.” The site was initially run by Svartholm and Neij, with Sunde and Lundstr\u00f6m joining later. From the outset the site attracted the attention of copyright holders and enforcement authorities, in part because its operators made no effort to comply with takedown requests. In an earlier Swedish proceeding, all four founders had been found guilty of authorising the unauthorised use of copyrighted material; they were sentenced to one year’s imprisonment and fined $4.8 million, though the sentence was subsequently reduced and the fine increased on appeal.<\/p>\n
The present acquittal arose from a separate legal process in which the four founders faced charges of copyright infringement, forgery, and abuse of electronic communications. Their defence centred on the assertion that all ties to Pirate Bay had been severed in 2006 when they sold the company and the website to a Seychelles-based company called Reservella, and that they had had no involvement with the file-sharing platform since that time. The Belgian court accepted this position, ruling that there was no evidence to show that any of the four defendants had been connected to the site between September 2011 and November 2013, the period covered by the charges. The prosecution was unable to furnish adequate evidence to prove the charges levied against them.<\/p>\n
