{"id":13857,"date":"2019-07-22T23:03:22","date_gmt":"2019-07-22T17:33:22","guid":{"rendered":"http:\/\/localhost\/one\/sinapse-blog\/?p=13857"},"modified":"2025-06-23T18:04:34","modified_gmt":"2025-06-23T12:34:34","slug":"trademark-registration-process-examination-india-legal-guide","status":"publish","type":"post","link":"https:\/\/www.bananaip.com\/intellepedia\/trademark-registration-process-examination-india-legal-guide\/","title":{"rendered":"An In-Depth Look at the Trademark Registration Process &#8211; Part IV"},"content":{"rendered":"<p>This post was first published on July 10, 2014.<\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 12pt;\">Now that we have had a look at the trademark filing process in the previous post, we will move on to discuss the trademark examination process.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 12pt;\">The process followed in the trademark registration process may be seen in the\u00a0flow chart below <em>(please click on image\u00a0to view clearly)<\/em>:<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 12pt;\"><!--more--><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 12pt;\">Upon the receipt of an application for trademark registration, the Trademark Office shall allot an Application Number used as a reference number for the application. Once the application is filed, the Trademark Office shall examine the application to examine whether the application satisfies the requirements of the relevant provisions under the Trade Marks Act and Rules. The requirements under the Rules are procedural, while those under the Act are substantive in nature. Examination of trademarks is\u00a0carried out with particular reference to the following sections:<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"font-size: 12pt;\">Section 2(1)(zb) \u2013 To see whether the mark comes within the scope of the definition of a trademark<\/span><\/li>\n<li><span style=\"font-size: 12pt;\">Section 9 \u2013\u00a0Absolute grounds for refusal<\/span><\/li>\n<li><span style=\"font-size: 12pt;\">Section 11 \u2013 Relative grounds for refusal<\/span><\/li>\n<li><span style=\"font-size: 12pt;\">Section 12 \u2013\u00a0Whether the mark is entitled to registration on the basis of honest and concurrent use, if proof for same is filed<\/span><\/li>\n<li><span style=\"font-size: 12pt;\">Section 13 \u2013\u00a0Whether the mark consists of the name of any chemical elements or international non-proprietary names<\/span><\/li>\n<li><span style=\"font-size: 12pt;\">Section 14 \u2013\u00a0Whether the marks consists of name of a living person or a person recently dead<\/span><\/li>\n<li><span style=\"font-size: 12pt;\">Section 15 \u2013\u00a0Whether the application is made for a part of another mark as a series<\/span><\/li>\n<li><span style=\"font-size: 12pt;\">Section 16 \u2013 Whether the association with other mark is necessary<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-size: 12pt;\">Once the examination of the application is completed, the Examiner shall issue an Examination Report. This report shall contain the objections raised by the Trademark Office, where, normally, the main objections fall\u00a0under Section 9 and 11 of the Trade Marks Act. The Response to the report should be filed within <strong>one month<\/strong> of receipt of the hard copy of the Examination Report.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 12pt;\">In order to expedite the process, the Response may be filed whenever it\u00a0is available in the official trademark database.\u00a0The Trademark Office has facilitated the process of filing the Response online through its database. The facility also enable users to file any other forms, any amendment for the existing application, change in proprietor\u2019s address or service address etc.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 12pt;\">If the applicant satisfactorily meets all the objections raised by the Trademark Office, the application will be advertised in the Trademark Journal, either as accepted or as advertised before acceptance.\u00a0An application may be advertised before acceptance if it relates to a mark to which section 9(1) and section 11(1) and (2) apply or in any other case where it appears that it is expedient by reason of exceptional circumstances.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 12pt;\">Where the application has been advertised before acceptance, the Registrar may in his discretion cause the application to be advertised again. Re-advertisement of the mark may also be ordered where an error in the application has been corrected or where the application has been amended under section 22.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 12pt;\">We will be looking into\u00a0the remaining Trademark Registration process in our upcoming\u00a0post.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>This post analyses the trademark examination stage in the Indian registration process, highlighting statutory requirements and responses to objections.
