{"id":111734,"date":"2024-06-24T22:05:10","date_gmt":"2024-06-24T16:35:10","guid":{"rendered":"https:\/?p=111734"},"modified":"2025-07-08T17:00:03","modified_gmt":"2025-07-08T11:30:03","slug":"trademark-infringement-betnesol-betnevin-glaxo-delhi-high-court","status":"publish","type":"post","link":"https:\/\/www.bananaip.com\/intellepedia\/trademark-infringement-betnesol-betnevin-glaxo-delhi-high-court\/","title":{"rendered":"Glaxo&#8217;s BETNESOL vs Zee&#8217;s BETNEVIN : Who do you BET on?"},"content":{"rendered":"<p>In this case, the Decree Holders, originally the Plaintiffs, Glaxo Group Limited and others (\u201cGlaxo\u201d) filed a petition seeking execution of the decree dated 01.12.2017 passed by the Delhi High Court.<\/p>\n<p>Glaxo had filed an infringement suit, CS (COMM) 1620\/2016 against the Judgment Debtors, originally the Defendants, Mr. Rajiv Mukul and another (\u201cMr. Mukul\u201d) seeking a permanent injunction. The suit was decreed in Glaxo\u2019s favour in terms of a joint compromise application and the terms in the plaint. Mr. Mukul was restrained from infringing or misappropriating Glaxo\u2019s registered trademarks such as ZENTEL, OTRIVIN, AMBIRIX, BOOSTRIX, POLIORIX, GRETORIX, PRIORIX, ROTARIX, TOCTINO, ZUCOX, or any other trademarks which amounts to infringement or passing off its goods as those of Glaxo\u2019s goods.<\/p>\n<p>Glaxo discovered Mr. Mukul\u2019s use of the mark, \u2018BETNEVIN\u2019 with similar packaging to its trademark, \u2018BETNESOL\u2019 prompting Glaxo to seek execution of the decree. Counsel for Mr. Mukul argued that the Executing Court is going beyond the terms of the decree to decide the infringement between the products and that a fresh suit should be filed, citing the case of Snapdeal (P) Ltd. v. Godaddycom LLC, (2022) 4 HCC (Del) 335. However, the Court noted that the cited case was an interim order and not an execution petition.<\/p>\n<p>The Court observed that in the present case, the execution petition was based on a decree resulting from a settlement between the parties. Relying on precedent, the Court upheld that, it could determine infringement in an execution petition to enforce the decree of injunction.<\/p>\n<p>In view of the above-mentioned circumstances, Mr. Mukul was restrained from using the mark \u2018BETNEVIN\u2019 and the product and packaging similar to \u2018BETNESOL\u2019.<\/p>\n<p><img decoding=\"async\" class=\"aligncenter\" src=\"http:\/\/bananaip.com\/wp-content\/uploads\/2024\/06\/Picture1-1.png\" \/><\/p>\n<p>&nbsp;<\/p>\n<h4>Relevant Paragraphs:<\/h4>\n<p style=\"padding-left: 120px;\"><em>\u201c15. The view of the Coordinate Bench of this Court as well as the Hon\u2019ble<\/em><br \/>\n<em>Supreme Court is that the Court in an execution petition can arrive at a<\/em><br \/>\n<em>finding that the products of the judgment-debtors are similar and infringing<\/em><br \/>\n<em>the trademark of the decree-holders, in order to execute the decree of<\/em><br \/>\n<em>injunction, can pass orders subsequently. The Hon\u2019ble Supreme Court has<\/em><br \/>\n<em>also held that it is immaterial if the term or directions in a decree is contrary<\/em><br \/>\n<em>to law. The Executing Court cannot go behind the same, and has to give<\/em><br \/>\n<em>effect to the decree.<\/em><br \/>\n<em>16. For the said reasons, the decree dated 01.12.2017 is required to be<\/em><br \/>\n<em>executed. I am also of the view that the product and packaging of the<\/em><br \/>\n<em>judgment-debtors is similar to and infringing the product and packaging of<\/em><br \/>\n<em>the decree-holders.
