In a decision  on 16 March, 2012, the Bombay High Court has held that an interim order passed before the date of acceptance of the counterclaim continues to be valid even after the case is transferred to the High Court.  The case related to a patent relating to ‘Fire Systems’. The patent holder sued the defendant for patent infringement in the Thane District Court. The defendant filed a written statement in response but did not counterclaim for revocation of the patent. The defendant later filed a counterclaim, which was not accepted by the District Court.
Yahoo taking on social networking giant Facebook seems to be the most debated issue in the IP industry now. Yahoo claims that Facebook infringes on 10 of its patent applications. Many of you would be looking for information on the 10 patents which Yahoo relied on to sue Facebook. Well, here we go.

In our earlier post, we had highlighted the ongoing patent war between Yahoo and Facebook. Yahoo has  threatened to sue Facebook over use of some of its patents. Following talks with Facebook, Yahoo has issued a statement by insisting that the social networking site either enter into a licensing agreement or that it will be compelled to move forward unilaterally to protect its rights….
The decision of the patent office to grant a compulsory license with respect to the patent over ‘Sorafenib’ for treatment of kidney and liver cancer is  a nicely crafted decision. It is probably the most  well reasoned decision of the patent office till date. The grant of compulsory license over ‘Sorafenib’ will surely take the drug to the needy and have a positive impact on health care…

In an interesting turn that took place, an Iranian Band has served a legal notice to music director Pritam Chakraborthy and Super cassettes Ltd., alleging copyright infringement. The popular song ‘pyaar ki pungi’ which is on everyone’s tongue these days from the movie Agent Vinod produced by Saif Ali Khan’s in house production house has been put in question by the Popular Iranian band Barobax Corp alleging that some of the initial verses were copied in its original form from their song ‘Soosan Khanoom’ which can be accessed from the YouTube link here.
The present case (Ratan v. Jaswinder Singh decided on March 7, 2012) is a Writ Petition filed  before the Gujarat High Court by Appellant (original defendant), challenging the order passed by the the Honorable City Civil Court. The City Civil Court had held that composite suit pertaining to trademark and copyrights are maintainable and the court is competent to entertain the same. In this regard, it had overlooked the decision of the Supreme Court in Dabur India Limited v. K.R. Industries. .
